The Supremacy Clause DOES NOT make the federal government superior to the States. It does declare that ONLY federal laws made in pursuance to the Constitution are the law of the land. If they go against the Constitution, as Alexander Hamilton said, they are expressly INVALID!

Sen. Reid Beefs up “Base Bill” to Destroy Gun Ownership "Unholy alliances" could become a concern We now know a lot more about what's going to happen with gun control legislation than we did a few days ago. First, the number of the bill we are fighting is S. 649. Harry Reid introduced it on Thursday and brought it directly onto the Senate calendar. This means the bill can now come up at any time — probably soon after the Easter recess is over. Second, the bill is a lot worse than even we anticipated. We expected it to contain the Veterans Gun Ban, which would mean that you would sell, gift, or raffle a gun in America at the risk of a 15-year prison sentence because of something you didn't know about the veteran/buyer. But, surprisingly to us, the Far Left has convinced Reid to include the original Schumer version of the Universal Registry Bill. This would ban private sales of firearms, unless purchasers first get the permission from the government. If Senators can pass this de facto registration bill, they will be well on the way to confiscation (see, for example, Governor Andrew Cuomo in New York, who has a gun owner registry and has called for gun confiscation). If this bill is passed, Senators will claim that they "broke the back" of gun owners in America. Third, there is still every evidence that Reid will move to proceed to the bill under "regular order," which means he will need 60 votes to advance to the "gun control buffet." GOA has been talking and making our case with a host of Senate Republicans, and we would hope that everyone in the Senate understands the importance of stopping the "motion to proceed" to Reid's gun control legislation. Fourth, as we predicted, anti-gun zealots have begun to use the "ObamaCare Paradigm" to threaten, bribe, and coerce senators into submission on the most far-reaching aspects of gun control, including Feinstein's proposal to ban shotguns, rifles and handguns that millions of Americans legally own. So if the "motion to proceed" to S. 649 is adopted with 60 votes, then Feinstein's ban could be passed in the Senate with only 50 votes (plus Biden). Already, articles are being published to intimidate any Democratic Senator who votes against any gun control and threatening them with the prospect of facing an anti-gun primary challenger — just like we saw on ObamaCare. Joe Manchin and the National Rifle Association are quietly engaged in private talks on a proposal to broaden background checks on purchasers of firearms." Last week a photo was sent to one of our local talk show hosts, Burnie Thompson who was outraged when he saw it.  It showed a PCB policeman carrying a fully automatic military rifle at the ready, desecrating our beautiful white sand beach among spring breakers.

Spring breakers do the following here, especially on the beach:

Drink
Party
Go to concerts
Patronize the beach clubs and drink some more
Get drunk
Smoke pot (which has a calming effect)
Engage in sex, sometimes unprotected, and depending on how high you are, experiment with one or more partners at a time
Risk pregnancy and STDs
Drive drunk or DUI
Occasional stabbings
They die of self-inflicted abuse, like alcohol poisoning, flying off balconies (a popular, though fatal sport), drowning in rip currents because they ignored the flag warnings, or driving drunk.  From what I know, there is little drug-induced deaths.  At least, that's not reported, and neither was this incident.

By the time they hit the sand they are drinking, eating, in the water and flirting.

They do not warrant this type of presence, and indeed, there was quite a flap and the officer(s) reprimanded.  But who told them to do it?  That person should be fired.

Panama City and Panama City Beach had better understand we have not much going for us except tourism. 

All of the law enforcement agencies in Bay County  are fully federalized.

On Wednesday, a Seattle City Council committee held a hearing to regulate unmanned police surveillance drones. The local Police Department already had two Draganflyer X6 Helicopter Tech drones bought with taxpayer money. A crowd of angry opponents, including the American Civil Liberties Union (ACLU), voiced spirited opposition to these spy drones, concerned about privacy.

Council members were accused of being “… more dangerous than Nazis... than Communists… than the Gestapo… than then KGB.” One citizen said the council was creating “a police state.”

By Sunday, the resulting city-wide uproar prompted Seattle Mayor Mike McGinn, down in local polls, to ground the drones, which were subsequently returned to the sellers, along with the demand for a refund.

Also last week, Charlottesville, Va., imposed a two-year moratorium on the use of unmanned surveillance drones, the first U.S. city to do so.

News reports indicated that Seattle City Council, hearing citizens from across the political spectrum, were roused in common cause by what they saw as a threat to their personal privacy – police eyes in the sky peering into their vehicles, yards, homes, bedrooms – looking for what?

That unity is an example for us all.

The Slippery Slope

Now put aside for a moment the lethal aerial drones Obama uses to destroy annoying human beings he judges to be imminent threats to Americans (whatever that means in a point of time).
How long will it be before the president and his lapdog attorney general conclude that Citizen X or Citizen Y are engaged in some nefarious actions that must be stopped, such as tax evasion or others offenses, such as hoarding precious metals or hiding unreported cash offshore.
Why waste time with due process and antiquated conventional investigative means? A tech-savvy, drone-happy president can order aerial surveillance of suspect groups or persons using a drone equipped with DARPA's surveillance video camera, ARGUS-IS (see demo), that at 15,000 feet over a small city can see and record movements as small as a human hand or the wagging of a dog’s tail. Arrest and confiscation of assets follow within minutes.

To target a suspect’s home or business, the president can order up a fleet of half-ounce Black Hornet Nano miniature surveillance helicopters, drones so small they can fit in the palm of your hand. Fitted with a tiny camera they relay still images and video to a remote video terminal manned by a police agent. The Nanos are so tiny a flock easily can hover outside your bedroom window like humming birds.

Surveillance drones already are used to patrol U.S. borders and by some U.S. police departments, but a year ago the U.S. Congress also got drone happy. Over little opposition or showing no concern about privacy, the politicians on the Hill ordered the Federal Aviation Administration to promote wider government, police and commercial drone use by September 30, 2015.

Congress ignored warnings about warrantless surveillance violations of the Fourth Amendment, police drones armed with tear gas and rubber bullets, which some departments want to use, and U.S. military drones in the U.S. sharing data with domestic law enforcement.

But the heart of the matter was summed up by Glenn Greenwald, a respected constitutional lawyer, who said about the leaked DOJ memo: “If you believe the president has the power to order U.S. citizens executed far from any battlefield with no charges or trial, then it’s truly hard to conceive of any asserted power you would find objectionable.”

Absolute Power Corrupts Absolutely

That is exactly the point – and why we should all be worried – why we should all be actively protesting the spreading use of drones as a potential means to violate all our constitutional rights.
If an omnipotent president can claim a general right to kill Americans whom he defines as “terrorists,” who and what will be on his terrorist list in the future?
Remember the 2001 PATRIOT Act adopted sight-unseen by Congress? Its broad definition of terrorism has been used to justify radical government actions, most kept secret as the Act permits.
Arial drones, unseen at great heights, can track your every move. Combine that all-seeing eye with GPS trackers on your cars, RFID chips in your IDs, wiretapping, Internet surveillance, passport control and FATCA.
Friends, plain clothed officers and unmarked police cars are relics of the past.
Yes indeed, the Constitution of the Unites States guarantees that we shall not be “deprived of life, liberty, or property, without due process of law,” that we have a right to trial and to be charged with a crime.
But if the president of the United States, as a Columbia Law School professor described President Obama’s actions a few days ago, “is acting as judge, jury and executioner,” how are we to defend ourselves?
We can at least start by demanding that Capitol Hill outlaw the use of surveillance drones against the 315,279,355 presumed innocent Americans now living in the United States.

Your Constitutional Rights have been repealed in ten states.

 

No, this isn’t a joke.   It is not exaggeration or hyperbole.  If you are in ten states in the United States, some of your rights guaranteed by the Bill of Rights have been made null and void.

 

And it is not just those ten states.  Those are just the states where everyone who lives in those states has lost some of their Constitutional Rights.  The sad truth is that there are only fourteen states where this stripping of the rights of American citizens has not yet happened.

What is going on?

The government has declared a one hundred mile zone around the United States borders to be a part of the border zone exception from the Fourth Amendment’s freedom from unreasonable searches and seizures. 

 

The Fourth Amendment states: The right of the people to be secure in their persons, houses, papers, and effects, against unreasonable searches and seizures, shall not be violated, and no Warrants shall issue, but upon probable cause, supported by Oath or affirmation, and particularly describing the place to be searched, and the persons or things to be seized.

 

Historically there has always been an exemption from the 4^th Amendment requirement; i.e.,  at the nation’s border.  This is the so-called border search exception to the Fourth Amendment.  Now the Department of Homeland Security is claiming the right to search electronic devices such as cell phones, laptops and tablet computers without a warrant or even any probable cause within that 100-mile zone.

 

If you live in Hawaii, or Maine, or New Hampshire, or Massachusetts, or Delaware or Rhode Island or Connecticut or Florida or Michigan, or New Jersey, congratulations, you live in a 4th Amendment-free zone !  It does not matter where you go in your state, the Department of Homeland Security can come in and demand to search your electronic devices.  They do not need any probable cause.

 

They can search you for the hell of it.

 

Those states listed are only the ones are totally covered by these “border security” search zones.  Other states like New York, Pennsylvania and Virginia have massive parts of their state that are covered by this too. 

 

This is a Constitution free zone.

 

Who is responsible for this outrage?

 

The Obama Regime is responsible of course, because Obama is currently in power.  Unfortunately this outrage started when George W. Bush was still in the White House. 

 

The language of the 4^th Amendment is clear.  It is the right of the people to be secure in their persons, houses, papers and effects from unreasonable searches and seizures. 

 

The government still has the right to search a laptop or a cell phone if the agents have probable cause and get a warrant or if they have probable cause and there are exigent circumstances. Electronic devices are the 21^st century equivalent of papers and are certainly our effects. 

 

If the Department of Homeland Security can search someone’s cell phone or laptop without a warrant or even probable cause because you are within 100 miles of the border, what is next?  Will the government start saying that if you live within 100 miles of the border, the Department of Homeland Security because of the border search exception to the Fourth Amendment now has the right to search cars and homes without either a warrant or even probable cause?

 

This is insanity and it must stop. 

 

Where is the Tea Party Caucus in the House of Representatives?  Why aren’t they screaming about this desecration of the Constitution?    Republicans should be the first to the floor of the House and Senate denouncing this and introducing legislation to rein in the Department of Homeland Security.
