NOTE: Two senators announced today (April 10, 2013) they have reached a "compromise" on so-called "universal background checks." This is a code word for universal gun registration.

A press announcement and the wording of a long new gun law are not the same thing. DO NOT BELIEVE any news media that treat them as the same.

I will read the bill when it is released. It has NOT been released. NO ONE knows what it says. "News" reports are blowing smoke at you. They have no idea what's in the bill, drafted in secret.

When senator Schumer recently said his background bill "explicitly" states no registration he lied. It said no such thing. The Associated Press quoted him anyway. The "news" media in general has become a direct enemy of gun rights in this country. They violate every ethical principle there is when dealing with this subject.

I'm working on a report about the current background check system. It denies people the right to obtain firearms without a trial or due process. Despite more than one million supposedly legitimate denials, less than 150 were prosecuted in a two-year period according to the government's own numbers, with an unknown number of convictions. Who are these people? A bureaucracy set up to deny rights with little oversight and virtually no results is extremely suspect. More later.

For now, look what is happening in this legislation just enacted.

Consider the goal. Will this save children in kindergarten classes?
Or is something more sinister at work?

Montana Governor Lies About the Constitution, Vetoes 2nd Amendment Protection Bill

Here's a surprise for you; some Governors have absolutely zero understanding of the Constitution.  None, whatsoever. Montana Governor Steve Bullock seems to fit that description quite nicely.
Yesterday, he vetoed Montana House Bill 302 (HB302).  The bill would require the state to refuse to enforce or assist the enforcement of any federal bans on semiautomatic weapons or large capacity magazines.  The bill states, in part:
A peace officer, state employee, or employee of any political subdivision is prohibited from enforcing, assisting in the enforcement of, or otherwise cooperating in the enforcement of a federal ban on semiautomatic weapons or large magazines and is also prohibited from participating in any federal enforcement action implementing a federal ban on semiautomatic weapons or large magazines.

Here's why Bullock is clueless about the Constitution.  In his veto message he wrote that the bill would put "law enforcement in the position of violating laws they have sworn to uphold" and "subject our peace officers to criminal sanctions for upholding the oath we ask that they take."
Here's a message for you, Steve.  You're a liar, and we know it.
There is absolutely ZERO serious discussion from anyone beyond a 4th grade education about the fact that the federal government cannot "commandeer" the states to carry out its laws.  None.
Even the Supreme Court has affirmed this multiple times.
In the 1992 case, New York v. United States, the Supreme Court ruled that Congress couldn't require states to enact specified waste disposal regulations.
In the 1997 case, Printz v. United States, the Supreme Court ruled that the federal government could not command state law enforcement authorities to conduct background checks on prospective handgun purchasers.
In the 2012 case, National Federation of Independent Business v. Sebelius, the Supreme Court ruled that a significant expansion of Medicaid, was not a valid exercise of Congress's spending power, as it would coerce states to either accept the expansion or risk losing existing Medicaid funding.
In each of these cases, the Supreme Court made is quite clear that their opinion is that the federal government cannot require the states to act, or even coerce them to act through a threat to lose funding.  Their opinion is correct.  If the feds pass a law, they can sure try to enforce it if they want.  But the states absolutely do NOT have to help them in any way. This is really basic stuff that no one disagrees with, except people like Steve Bullock when their trying to mislead people.
So to say that Montana law enforcement would be "violating laws" or "subject...to criminal sanctions" for not carrying out federal law FOR the feds is a bald faced lie.  And Steve Bullock knows it.
The people of Montana should be disgusted.
On the right, those who support the right to keep and bear arms know that no matter what gun laws are ever passed in DC - this year or in the future - Steve Bullock will require the state of Montana to enforce them.
On the left, those who support the medical marijuana program that voters approved years ago, know that Bullock will continue to be an embarrassment to progressives, requiring local law enforcement to continue working with the DEA when they don't even have to.
Now if Bullock would have skipped this part of the veto message and just focused on the political statement that he also included, that would be more...acceptable.  Still wrong-headed and dangerous, but not as bad as his lie that the state needs to carry out and enforce every federal law.  He wants your local law enforcement to take all the risk, and to bear all the cost, while the feds sit back and do nothing or take the credit where the local law enforcement carries all the water.
His veto message continues:
Further, HB 302 is unnecessary. To date, there has been no action in Congress to enact a ban on semiautomatic weapons. Moreover, recent news reports have indicated that a majority of Congress does not support such legislation.
That may be the case for 2013, and it's certainly decent news for the short term.  But, anyone thinking that this is over with because it won't pass in 2013 is mistaken.  Anyone saying "there's nothing to worry about" is a liar.   If you don't believe me, maybe you'll believe Joe Biden:
"Let me say this as clearly as I can: this is just the beginning," he said just this week. "We believe that weapons of war have no place on our streets. That's the message that retired admirals and generals have spoken to us about. The comment one of them used was if you want to learn how to use a semiautomatic weapon, join the United States military. But these are weapons of war."
The attempts to ban semiautomatic weapons and high capacity magazines are just beginning  and making sure that the federal government knows that they'll get no support enforcing such a ban from the State of Montana, is a good first step in rendering any such ban ineffective.
As Judge Andrew Napolitano has said recently, such widespread noncompliance can make a federal law "nearly impossible to enforce." 

Steve Bullock is a joke, and while we realize that no one is going to vote this bum out of office anytime soon, the People of Montana can certainly pressure their state senators and representatives to override his veto and render worthless his constitutional-idiocy.
For Bullock to say such garbage about Montana being required to enforce federal law, we say "Bollocks!"

"Unholy alliances" could become a concern
We now know a lot more about what's going to happen with gun control legislation than we did a few days ago.
First, the number of the bill we are fighting is S. 649. Harry Reid introduced it on Thursday and brought it directly onto the Senate calendar. This means the bill can now come up at any time — probably soon after the Easter recess is over.
Second, the bill is a lot worse than even we anticipated.
We expected it to contain the Veterans Gun Ban, which would mean that you would sell, gift, or raffle a gun in America at the risk of a 15-year prison sentence because of something you didn't know about the veteran/buyer.
But, surprisingly to us, the Far Left has convinced Reid to include the original Schumer version of the Universal Registry Bill. This would ban private sales of firearms, unless purchasers first get the permission from the government. If Senators can pass this de facto registration bill, they will be well on the way to confiscation (see, for example, Governor Andrew Cuomo in New York, who has a gun owner registry and has called for gun confiscation). If this bill is passed, Senators will claim that they "broke the back" of gun owners in America.
Third, there is still every evidence that Reid will move to proceed to the bill under "regular order," which means he will need 60 votes to advance to the "gun control buffet."
GOA has been talking and making our case with a host of Senate Republicans, and we would hope that everyone in the Senate understands the importance of stopping the "motion to proceed" to Reid's gun control legislation.
Fourth, as we predicted, anti-gun zealots have begun to use the "ObamaCare Paradigm" to threaten, bribe, and coerce senators into submission on the most far-reaching aspects of gun control, including Feinstein's proposal to ban shotguns, rifles and handguns that millions of Americans legally own. So if the "motion to proceed" to S. 649 is adopted with 60 votes, then Feinstein's ban could be passed in the Senate with only 50 votes (plus Biden). Already, articles are being published to intimidate any Democratic Senator who votes against any gun control and threatening them with the prospect of facing an anti-gun primary challenger — just like we saw on ObamaCare.
Fifth, there may be unholy alliances at work which could succeed in achieving a dangerous gun control compromise. One Capitol Hill newspaper is now reporting that "Sen. Joe Manchin and the National Rifle Association are quietly engaged in private talks on a proposal to broaden background checks on purchasers of firearms." We hope this is not true, however you should be aware of this report and use whatever contacts you have to prevent this from happening. Be assured, you can rely on Gun Owners of America to never engage in any compromises!
ACTION: The strategy remains: We need to defeat this bill by filibustering and voting down the "motion to proceed" to S. 649. Please contact your senators and distribute this alert far and wide.
Show up at their offices with a delegation during the congressional recess. Rally and conduct demonstrations and call-a-thons and writing campaigns. Know that the anti-gun Left will be doing the same.

Senators on Capitol Hill are telling Gun Owners of America that Harry Reid is twisting arms to get support for one of the most anti-gun judicial nominees in recent memory.
 
Her name is Caitlin Halligan, and she has a long track record in favor of gun control.  In fact, one Senate Republican said that she is the most “anti-Second Amendment nominee Obama has ever put forward.”
 
As New York’s Solicitor General, Halligan was one of the chief lawyers responsible for New York’s baseless and politically motivated efforts to bankrupt gun manufacturers using frivolous litigation. In so doing, Halligan proved that she places liberal political activism above fealty to the law.
 
Halligan’s public hatred for firearms was only matched by her zealotry inside the courtroom. In a speech on May 5, 2003, Halligan called for “handgun manufacturers [to be held] liable for criminal acts committed with handguns.”
 
Certainly, no other manufacturer of another item -- whether it be cars, baseball bats, or anything else -- would be held liable for the criminal misuse of its product. And, as Halligan well knows, the application of that principle to firearms would surely eliminate the manufacture of firearms in America.
 
After attempts of legal extortion of the firearms industry were repudiated by a bipartisan vote in Congress, Halligan’s office did not let up on attacking gun rights, signing a legal brief calling for New York courts to declare the federal Gun Makers’ Protection Act unconstitutional.
 
Finally, Halligan, in written testimony submitted to the Senate in connection with her nomination, attempted to conceal the extent of her anti-gun animus.
 
Halligan’s failure to provide information that would clarify her statements, thus keeping her testimony from being misleading, constitutes “fraud” against the Senate. As such, the only role she should play in the D.C. Circuit Court of Appeals is the role of a defendant.
 
But, of course, none of this matters to Harry Reid. He and President Obama are doing what they can to pack the Appeals Courts with radical leftists.
 
We have to stop this Reid/Obama court-packing scheme. Please act now, as Reid is pushing hard for a vote on Halligan’s nomination.
