Negative Posting About Islam in U.S. Now Subject to Federal Prosecution and Imprisonment

Remember reading that England had arrested a guy for anti-Muslim Twitter postings in the aftermath of the Woolwich slaughter? And remember thinking, "Well, this is America, that can't happen here"?

Oh yes it can.

US Attorney Bill Killian, Obama's Attorney for the Eastern district of Tennessee wants you to know that if you say something untoward (negative) about Muslims, the Federal government may imprison you.

Killian and Moore will provide input on how civil rights can be violated by those who post inflammatory documents targeted at Muslims on social media. “This is an educational effort with civil rights laws as they play into freedom of religion and exercising freedom of religion,” Killian told The News Monday. “This is also to inform the public what federal laws are in effect and what the consequences are.” ... Killian said Internet postings that violate civil rights are subject to federal jurisdiction.

The posting he offers as a "for instance" is an egregious one. And yet this country has long protected, absolutely, egregious speech, such as hardcore pornography, for a simple reason: Either you are at liberty to say what you will or you are not. If you are constantly double-thinking every word you might say, for fear of being prosecuted, you are self-censoring, in anticipation of a possible prosecution by the government.

Rather than having a system in which people were constantly worried about imprisonment for speech, our country has evolved a simple bright-line code: Speech of all kinds, with a few exceptions that can be counted on three fingers, is absolutely protected.

Remember, the importance of this bright-line, no-exceptions rule of free speech was preached to us, even when some of us might not have liked it so much, as when hardcore pornography was afforded absolute protection under the First Amendment. In the case of hardcore pornography, it was argued -- successfully -- that having each artist weigh the possibility of an obscenity prosecution was too much of a burden on his free speech rights, and would have, unavoidably, a chilling effect on speech.

That was the rule then, and that was the rationale.

But now comes the Obama Administration to tell you that Yes, you just might be imprisoned for something you say online, so you'd better Watch What You Say.

Remember when Ari Fleischer said that, without suggesting any kind of legal penalties? Remember how the media freaked out?

But now comes the US Attorney for the Eastern district of Tennessee explicitly telling you that you may be imprisoned if a political appointee decides your political speech has crossed a line.

Somehow, I don't think Tim Robbins will be portentously howling us that a "chill wind" is blowing across our rights of free expression this week.

IRS Agent: DC 'Task Force' Made Decisions About Tea Party Applications

There were three interesting headlines to come out of today’s NBC News report about the widening IRS scandal. We learned that one Tea Party group received an IRS letter demanding answers to intrusive questions as recently as three weeks ago; that higher-ups outside of OH were involved in the paralyzing harassment of Obama’s political foes; and that there might be a special “task force” in Washington DC behind all of it.

Buried near the bottom of the NBC News report isthis fascinating factoid:

Cleta Mitchell, another attorney representing conservative groups that allege they were targeted, said an IRS agent in Cincinnati told her a “task force” IRS office in Washington, D.C., was making the decisions about the processing of applications, and that she subsequently dealt with IRS representatives there.

“(The IRS agent in Cincinnati) told me that in fact the case would be transferred to a special task force out of Washington, and that he was told – he was the originally assigned agent – that he wasn’t allowed to make decisions, the decisions were all going to be made in Washington,” Mitchell said. “I know that this process was going on in Washington because I’ve dealt with those people.”

We sure are a long way from the Obama Administration’s initial spin that all of this was caused by two rogue agents in a single office.

To reinstate the semi-auto ban? Or, to allow Obama to turn anyone into a “prohibited person” and take away their guns, simply by putting them on a secret “watch list”?   To ask such questions is to answer them.  The political Left would love to disarm us all and take away our guns.  To wit, the nation had to endure Bob Costas’ rant over the weekend when he essentially suggested that otherwise law-abiding people shouldn’t have guns.   Click hear to see GOA Executive Director Larry Pratt’s answer and rebuke to Bob Costas for his ill-informed comments in the wake of the Javon Belcher suicide.    But, in order to push a progressive agenda through the Senate, Reid is first going to have to use his deceptive “cheat scheme” in order to change the Senate rules to make it easier to pass the Left’s anti-gun initiatives.   By eliminating the filibuster (on the motion to take up legislation), Reid intends to eliminate our most effective way to kill a bad anti-gun bill -- that is, by weakening or eliminating the time-honored filibuster that makes the Senate so different from the House.   But, even more important, if Reid uses the “nuclear option,” as he’s threatening to do, the Senate no longer has any binding rules.
