Senators Paul, Cruz and Lee to Lead Filibuster
of Reid’s Gun Control Bribe-o-thon

On the heels of a test vote last Saturday where 50 Senators — including six “Red State” Democrats — voted for an amendment offered by Senator Mike Lee (R-UT) to prohibit virtually all gun control legislation in the Senate, three senators have committed to filibuster any motion to proceed to any gun control legislation.
The three Republican Senators — Rand Paul of Kentucky, Ted Cruz of Texas and Lee of Utah - have cosigned a letter indicating that they would filibuster a motion to proceed to S. 649.
S. 649 already contains the Veterans Gun Ban, which could send you to prison for 15 years for selling, raffling or gifting a firearm in America, while not realizing that the recipient was disqualified in some way — say, for being a military veteran with PTSD or for being a habitual user of marijuana (for medical purposes).
In addition, S. 649 contains Chuck Schumer's universal gun registry legislation. Although he doesn't have 60 votes now, Schumer will ruthlessly work to get weak-kneed Republicans to endorse some version of universal registries.
Finally, Reid will allow amendments to S. 649 consisting of the Feinstein gun ban, a magazine ban, and whatever other gun control proposals he feels he can cram down our throats. But not if the Paul-Cruz-Lee filibuster is successful, as the Senate will never reach Reid's gun control bribe-o-rama where he will be able to threaten, bribe, and coerce other Senators into getting the votes he needs to pass a myriad of gun control restrictions.
ACTION: Click here to contact your Senators. Demand that they support the Paul-Cruz-Lee filibuster of the motion to proceed to S. 649 and to resist Harry Reid's gun control bribe-o-rama.

LEE JOINS PAUL IN TALKING FILIBUSTER AGAINST CIA NOMINEE BRENNAN (YOU KNOW, THE IRISH MUSLIM)

Lee joins Paul in talking filibuster against CIA nominee Brennan

Sen. Mike Lee (R-Utah) on Wednesday joined Sen. Rand Paul (R-Ky.) in his talking filibuster against the nomination of John Brennan to be director of the Central Intelligence Agency (CIA).

“Americans have every reason to be concerned any time the government wants to intrude on life, liberty or prosperity,” Lee said. “We’re talking here about the sanctity of human life and we have to take steps to protect that.”
Paul had been speaking from the Senate floor for more than three hours before another GOP member joined him.
“I’m here to filibuster John Brennan’s nomination to be director of CIA,” Paul said on the Senate floor Wednesday. “I will speak for as long as it takes."

“I will speak today until the president says, ‘no’ he will not kill you at a café or in your home.”
Paul has said he wants more answers from the administration on whether American citizens can be targeted by armed drones inside the United States before he'll lift his filibuster on Brennan's nomination. 
No American should be killed by a drone on American soil without first being found guilty of a crime,” Paul said. “That an American could be killed on American soil is an abomination.” Paul noted that his throat was getting dry as he passed the one-hour mark of the talking filibuster, which has become rare in the upper chamber. Senators are allowed to filibuster without commanding the floor, so few choose to hold up nominations or legislation by speaking. 

"This is the first time I’ve come to the floor to use a true talking filibuster," Paul said. "It almost never happens. … I don’t think I’ve ever seen some one come and speak in a filibuster before."
Senate Majority Leader Harry Reid (D-Nev.) said earlier Wednesday that he had hoped to have a vote on Brennan’s nomination so that lawmakers could leave town before a snowstorm prevented members from heading home for the weekend.
The Senate Intelligence panel in a 12-3 vote on Tuesday approved Brennan, but Paul has said he will keep his filibuster going until President Obama says he will not kill Americans by drone attack on American soil.
“Has America the Beautiful become ‘Alice in Wonderland’?” Paul said. “When I asked the president can you kill an American on American soil, it should have been an easy answer — an unequivocal "no."
“But his answer was, ‘I haven’t killed anyone yet and I have no intention of killing Americans, but I might.’ ”
Paul said the possibility that a citizen could be targeted without being charged in the courts went against the Fifth Amendment of the Constitution, which gives citizens the right to a trial by a jury of their peers.

“The Fifth Amendment should also protect you from a president who might kill you with a drone,” Paul said. “No American should be killed in their house without a warrant. … But [Obama] says trust him, he hasn’t done it yet.

“Mr. President that’s not good enough. … I will not sit quietly in my office and let him shred the Constitution.”
Recently released Justice Department documents claim the CIA and the DOD have the legal right to take out terror suspects across the globe via armed drone strikes, even if those suspects happen to be U.S. citizens.
The legal justifications allowing armed drones to take out U.S. citizens suspected of terrorism overseas would open the door to such strikes against Americans inside the U.S., according to Paul.

Attorney General Eric Holder this week declined to rule out armed-drone strikes on American soil, though he said it's a far-fetched scenario.

In a letter sent to Paul before Brennan's confirmation vote, Holder said the White House "has no intention" of launching drone strikes on American soil, saying the administration "rejects the use of military force" inside the U.S. when "well-established law enforcement authorities" exist.

"The question you have posed is therefore entirely hypothetical, unlikely to occur, and one we hope no president will ever have to confront," Holder wrote. 
Lee said that Holder’s memo expressed a “standardless standard.”
“No one can reasonably look into this and see who the government may kill with a drone and who the government won’t kill with a drone,” Lee said.

RAND PAUL ON THE SOTU SPEECH W/VIDEOS


Last night, during his State of the Union address, President Obama called for more government, more taxes and more debt to solve our nation's problems.

Quite frankly, I couldn't disagree more with the President.

As I said in my Tea Party response to the President's SOTU, "the path we are on is not sustainable, but few in Congress or in this Administration seem to recognize that their actions are endangering the prosperity of this great nation."



I agree with Ronald Reagan who said that government is not the answer to the problem - government is the problem.

I pledge to you that as long as I'm in Washington, I will continue fighting to restore the Founding principles of individual liberty, free markets, and constitutional government in America.

I hope I can count on your continued support.

The Environmental Protection Agency is out-of-control. And your property could be next.

Too often, our rights are being violated by abusive and power-hungry EPA bureaucrats, using threats, coercion and force to implement their power grabs.

These regulations have hampered landowners' ability to manage their private property as they please and have impaired job creation. Americans are suffering from the overreach of regulatory agencies such as the EPA.

Our economy, job growth and private property rights are at stake.

Today, I'm asking you to stand with me and start to fight back against an out-of-control federal government.

Please take a minute to sign the "Defense of Property" petition I've had prepared for you, and if possible, lend your support today to our effort to stop the Obama EPA in its tracks.

I'll give you a link in a moment, but I want to tell you why this legislation is so vital.

When power is left in the hands of the executive, it will ALWAYS grow. There is no mechanism to stop it within the executive branch.

Budgets will balloon.

Pages of regulations will proud. And power will cause those in charge to act like masters instead of servants, something that happens all too frequently in our government these days.
**      EPA regulations cost more than 5 percent of our annual gross domestic product, the equivalent of the costs of defense and homeland security combined.
**      Since EPA regulations have been taking property, jobs and businesses away from citizens, unemployment in America has increased by 33 percent.
**      This abuse of power by the implementation of regulations infringes upon our basic rights, and it harms each and every one of us whether or not we are affected directly by one of their rules.

But that's not all.

These are the facts, but there are also the stories, the faces, the suffering.

The omnipresent harassment of the government in the lives of ordinary Americans.

In Pennsylvania, take the story of John Pozsgai, an immigrant from Hungary, who worked as a mechanic and eventually saved enough money to purchase the land bordering his home in Morrisville, Pa.

This land was an old auto junkyard, and Mr. Pozsgai, taking pride in his home, proceeded to clean up this landfill by removing 7,000 old tires and rusted-out automobiles.

However, the EPA did not view this effort as a clean-up but rather a violation of the Clean Water Act.

You see, Mr. Pozsgai's property was a "wetland," ambiguously defined by the EPA as any property that has some sort of connection to a wetland. That connection to a wetland was a small drainage ditch located on the edge of his property.

Mr. Pozsgai did not need a permit to dump topsoil on an isolated wetland.
However, the Army Corps of Engineers insisted he apply for one. Next, the EPA set up surveillance cameras to capture Mr. Pozsgai filling his land with topsoil. EPA agents then arrested him for "discharging pollutants into waters of the United States."

These "pollutants" consisted of earth, topsoil and sand. The EPA openly admits that no hazardous wastes were involved in the case, yet Mr. Pozsgai was found guilty and sentenced to three years in prison and fined $202,000. Mr. Pozsgai spent 1 1/2 years in prison, 1 1/2 in a halfway house, and was under supervised probation for five years. His family went bankrupt and was unable to pay its property taxes on the land.

You may have recently heard the case of Mr. and Mrs. Michael Sackett, of Priest Lake, Idaho, who have also fallen victim to the EPA's abusive and overbearing practices.

The Sackett family sought to build a house on their half-acre of land, yet after construction broke ground, the EPA interfered, claiming the family violated the Clean Water Act by placing fill materials into "wetlands."

Their property was designated as a wetland, yet their neighbors have built houses on either side of their lot and their lot already has established sewage lines.

Their lot does not harbor a lake, pond or stream, yet the EPA is requiring them to obtain a building permit that would cost more than the value of their land.

The Sacketts proceeded by filing suit, but the request was dismissed by a federal judge. This past month, the Supreme Court ruled 9-0 in the Sackett's favor, giving them a partial victory, but leaving the regulations that harassed them in place.

The repeated abuse of power by the EPA has been noted across the country, infringing on the lives of all Americans.

Property rights were once regarded as fundamental to the protection of liberty, and it is time that legislators restore the value of personal property and do something about governmental overreach.

That's why I introduced the Defense of the Environment and Property Act, which would finally define wetlands and navigable waters in the law, and stop the out-of-control EPA and its war on private property.

And that is why it's vital you act today to help pass this crucial bill.
