Montana Attorney General Signs Amicus Brief Supporting Second Amendment Incorporation

Two-thirds of the nation’s attorneys general have filed an amicus brief asking the U.S. Supreme Court to grant certiorari in the case of NRA v. Chicago and hold that the Second Amendment applies to state and local governments through the Due Process Clause of the Fourteenth Amendment. This bi-partisan group of 33 attorneys general, along with the Attorney General of California in a separate filing, agrees with the NRA’s position that the Second Amendment protects a fundamental individual right to keep and bear arms, disagreeing with the decision recently issued by a three-judge panel of the U.S. Court of Appeals for the Seventh Circuit.
Attorney General Bullock was one of the many who agrees that the Second Amendment is a fundamental individual right and signed the amicus brief. What's Wrong With This Picture?

Proponents of “gun control” are screaming bloody murder over Democratic New York Governor David Paterson’s appointment of little known Kirsten Gillibrand to replace Hillary Clinton in the United States Senate.

Now get this: The NRA gives Democrat Congresswoman Gillibrand an “A” for her anti “gun control” stances. This is weird.

Why? Because Governor Paterson has been given an “F” for his “gun control” stances by the same group.

Additionally, insiders report that New York Senator Charles Schumer, of all people, was Gillibrand’s staunchest advocate! Weird upon weird, I say.

In case you didn’t know, Senator Charles Schumer is arguably the most notorious (reviled?) anti gun ownership advocate in the history of American politics, and is ranked at least an “F triple minus“ by every pro gun ownership organization.

So how do you explain Schumer’s advocacy of Gillibrand to Paterson? Seriously, what the heck is going on here?

Did Chuck Schumer get an AR-15 for his birthday, go shooting, and see the error of his ways? Is he planning to turn on (rhetorically) his fellow anti gunners like Dianne Feinstein, Barbara Boxer, and that screeching dingbat Carolyn McCarthy? Nah, something tells me that isn’t what’s going on.

Are Paterson and Schumer sending some sort subtle/not-so-subtle message to President Obama? Does Paterson have some hidden beef with Obama? Does Schumer have some beef with Obama that goes back to the way Madam Clinton was treated during the primaries? After all, Chuck would have been way at the front of the appointments line with a President Hillary. We should never forget that politics is mostly gutter fighting, deceit, and revenge.

And therefore, pro gun activists should not be an all too trusting bunch when it comes to politicians. We’ve been betrayed for decades by people we thought we could count on, recently G.W. Bush and John McCain amongst others.

And now, from out of the woods of upstate New York comes this attractive, blonde, somewhat Sarah Palinesque, gun rights activist to apparently carry our banner into the dragon’s lair? Sorry, but you can color me suspicious.

However, President Obama’s plate is wriggling with immediate, high priority, conundrums. He faces two losing (and socially unpopular) military campaigns in Afghanistan and Iraq. Staring him in the face is a transportation infrastructure falling to pieces, a health care system tattering in the breeze, the somber threat of another 9-11, twenty million illegal aliens ensconced within our borders, a tanking global economy, and an American dollar that is on the ropes.

Could it be that the red herring wavers of “gun control” simply won’t be able to get his ear right now? Is “gun control” maybe (as he has indirectly implied) going to be a non-issue for his first term? Do you believe in the tooth fairy?

And now there is Democrat chatter of Gillibrand doing a “180” on her pro gun stances. Is this a lie to calm the victim disarmament advocates in Liberalville … or is it the truth, and part of a bigger scheme?

Ayn Rand wrote a famous novel titled “Atlas Shrugged”. A memorable line in the book is: “Who is John Galt?” (The answer to the question pays off in the story.)

I would paraphrase Ms. Rand’s question: “Who is Kirsten Gillibrand?” To one degree or another, the answer to that question will pay off in our lives. And pretty soon. You can bet on that.

The first draft of the Second Amendment said, "The right of the people to keep and bear arms shall not be infringed, a Well regulated (which meant at the time WELL ARMED, NOT WELL CONTROLLED) militia being necessary to the security of a free state. It was changed to make it sound better, not restrict the rights of the people. I always tell people that there are some linguistic differences between the 18th and 20th centuries that when they are taken into consideration makes the intent of the founder very clear. Here is what I mean. At the time of the writing of the Constitution, the phrase "well regulated" meant well armed with the most modern of weapons. The British considered the rifled muskets of the Colonial Army as unfair implements. The Colonists loved them for their long range accuracy in comparison to the smooth bore Brown Bess of the British Army. And since almost all members of the colonial army had to provide their own weapon, the founding fathers wanted them to have the most advanced weapon possible. In the terminology of the time, the "Militia" was considered to be all adult males of sound mind and character (I.e. no felons). And I would hazard a guess that the idea of a "Free State" didn't mean a political body as much as a state of freedom. Remember, they had just fought a bloody 8 yr long war who's outcome was in doubt until the very end against a tyrannical despot. Under that context, an interpretation of the second amendment of " A well armed citizenry, being necessary to the security of the state of freedom, the right of the people to keep and bear arms shall not be infringed." is probably spot on to the original intent of the founding fathers. That leaves little to the imagination for some attornies to try and twist. This country went for almost 120 years without more than a handful of gun laws. We now have over 10,000 and crime had risen dramatically (and still remains high in non shall issue states) until the right to carry a concealed weapon was reaffirmed in the 38 states that now have "Shall Issue" legislation on the books. Crime has consistently dropped wherever Shall issue and Castle doctrine laws have passed.

Based on his voting record in the Illinois state senate and in the
U.S. Senate, President-elect Barack Obama will be the most
anti-Second Amendment president in the history of America.

In January, the new President will govern alongside congressional
leadership, House Speaker Nancy Pelosi and Senate Majority Leader
Harry Reid, who are also extremely hostile to gun rights and who now
enjoy greatly expanded majorities.

There can be little doubt about the direction in which gun rights are
headed. The questions are how far will the anti-gunners go and how
fast will they move?

Many comparisons have been made to the first two years of the first
Clinton Administration, in which one party controlled both ends of
Pennsylvania Avenue.

Almost all experts agree that it was Clinton's overreaching on issues
like gun control that cost his party control of Congress. Barack
Obama will start out governing with even larger majorities than did
Clinton.

Obama ran a campaign high on rhetoric and short on specifics. The
President-elect claims he will govern from the middle, but the
question for gun owners is which Obama will show up at the White
House -- the "centrist" from the campaign trail, or the radical
anti-Second Amendment extremist who supports gun bans, waiting
periods for firearm purchases, one gun a month restrictions, and
more?

His party's large gains in the Congress give the incoming President
more room to maneuver with a radical agenda.

An equally important question is the outlook for gun rights in the
new Congress. That Obama will sign any anti-gun bill that gets to
his desk is a certainty. But what can gun owners expect from the new
Congress?

Hopes of Congressional restraint on gun issues dimmed with each
election return as Pelosi's and Reid's majorities grew to historic
proportions.

While there are many moderately pro-gun Democrats in Congress,
they're not the ones calling the shots. The leadership is completely
in the anti-gun camp, so expanding their majority would have a
negative impact on gun rights regardless of who filled those seats.

Unfortunately, though, many seats that flipped parties also went from
strong pro-gun to strong anti-gun. Gun owners suffered heavy losses
in the Senate. Here's a look at five Senate seats that switched
parties (all switches went from Republican to Democrat).

Colorado -- The retirement of A-rated Senator Wayne Allard set up a
battle between anti-gun Rep. Mark Udall and pro-gun former Rep. Bob
Schaffer. This is one of three senate seats that flipped from "A" to
"F."

New Hampshire -- Pro-gun Senator John Sununu was defeated by F-rated
former governor Jeanne Shaheen, another "A" to "F" shift.

New Mexico -- Long-time Senator Pete Domenici, who was D-rated and
usually voted against gun owners, was replaced by F-rated Congressman
Tom Udall. Udall defeated A-rated Representative Steve Pearce,
making this a big loss for gun owners.

North Carolina -- Republican Sen. Elizabeth Dole ran as a pro-gun
control candidate for president in 2000. Since being elected to the
Senate from the Tar Heel state, however, Mrs. Dole compiled a good
pro-gun record. Dole's defeat at the hands of F-rated anti-gunner
Kay Hagan is a dramatic flip for gun rights.

Virginia -- F-rated Republican John Warner retired. Former governor
Mark Warner (no relation) trounced "A" rated Jim Gilmore, also a
former governor. Either of the candidates would have been an
improvement over the retiring Senator, but Mark Warner refused to
answer the GOA survey and has a mixed record on gun issues.

In the battle for the U.S. House of Representatives, gun owners also
were hit hard.

Of the 18 incumbents who were defeated, 15 were pro-gun (only two
were replaced by a pro-gunner). Of particular disappointment to gun
owners were the losses of Republican representatives Marilyn Musgrave
(CO-4), Tom Feeney (FL-24), Bill Sali (ID-1), and Tim Walberg (MI-7).
These representatives were among the most ardent Second Amendment
supporters.

In the 32 open House seats, the results were mixed. Thirteen seats
went to A-rated candidates, while six went to F-rated anti-gunners.
Nine new congressmen are "Not Rated," meaning they have no record and
refused to fill out a GOA questionnaire. Four new members fall
somewhere in the middle, leaning toward a pro-gun position but no
guarantees. Note: a handful of close races across the country are
obviously headed for recounts, but this is how things look at the
moment.

The A-rated winners in open seat elections are: Tom McClintock (R-CA)
(this race is still subject to change), Duncan Hunter (R-CA), Bill
Posey (R-FL), Mike Coffman (R-CO), Debbie Halvorson (D-IL), Aaron
Schock (R-IL), Brett Guthrie (R-KY), Erik Paulsen (R-MN), Blaine
Luetkemeyer (R-MO), Christopher Lee (R-NY), Glenn Thompson (R-PA),
Jason Chaffetz (R-UT), and Cynthia Lummis (R-WY). These
representatives will have their work cut out for them, as the new
Congress has moved decidedly in the anti-gun direction and many
pro-gun leaders were defeated.

All in all, Nancy Pelosi and Harry Reid can’t help but be emboldened
by their gains and there can be no denying that gun control
legislation is on their agenda.

So what can gun owners and sportsmen do to help prevent a gun control
tidal wave? Get involved and stay engaged!

Teaching your children to handle firearms in a safe and responsible manner is like sending your children off to the local dojo to learn karate. Just another form of protection and survival - if needed.

Quiz them. Ask your neighbors if they know them or are familiar with the Constitution and the Declaration of Independence. Teach them. If you have taken your freedoms for granted, then you need to learn them. Make it a family affair!
