Gun Owners of America Senators Paul, Cruz and Lee to Lead Filibuster of Reid’s Gun Control Bribe-o-thon On the heels of a test vote last Saturday where 50 Senators — including six “Red State” Democrats — voted for an amendment offered by Senator Mike Lee (R-UT) to prohibit virtually all gun control legislation in the Senate, three senators have committed to filibuster any motion to proceed to any gun control legislation. The three Republican Senators — Rand Paul of Kentucky, Ted Cruz of Texas and Lee of Utah - have cosigned a letter indicating that they would filibuster a motion to proceed to S. 649. S. 649 already contains the Veterans Gun Ban, which could send you to prison for 15 years for selling, raffling or gifting a firearm in America, while not realizing that the recipient was disqualified in some way — say, for being a military veteran with PTSD or for being a habitual user of marijuana (for medical purposes). In addition, S. 649 contains Chuck Schumer's universal gun registry legislation. Although he doesn't have 60 votes now, Schumer will ruthlessly work to get weak-kneed Republicans to endorse some version of universal registries. Finally, Reid will allow amendments to S. 649 consisting of the Feinstein gun ban, a magazine ban, and whatever other gun control proposals he feels he can cram down our throats. Gun Owners of America   Obama Pushing “Most Anti-Second Amendment Nominee” in Recent History Contact your U.S. Senators right away!   Senators on Capitol Hill are telling Gun Owners of America that Harry Reid is twisting arms to get support for one of the most anti-gun judicial nominees in recent memory.   Her name is Caitlin Halligan, and she has a long track record in favor of gun control.  In fact, one Senate Republican said that she is the most “anti-Second Amendment nominee Obama has ever put forward.”   As New York’s Solicitor General, Halligan was one of the chief lawyers responsible for New York’s baseless and politically motivated efforts to bankrupt gun manufacturers using frivolous litigation. In so doing, Halligan proved that she places liberal political activism above fealty to the law.   Halligan’s public hatred for firearms was only matched by her zealotry inside the courtroom. In a speech on May 5, 2003, Halligan called for “handgun manufacturers [to be held] liable for criminal acts committed with handguns.”   Certainly, no other manufacturer of another item -- whether it be cars, baseball bats, or anything else -- would be held liable for the criminal misuse of its product. And, as Halligan well knows, the application of that principle to firearms would surely eliminate the manufacture of firearms in America.   After attempts of legal extortion of the firearms industry were repudiated by a bipartisan vote in Congress, Halligan’s office did not let up on attacking gun rights, signing a legal brief calling for New York courts to declare the federal Gun Makers’ Protection Act unconstitutional.   Finally, Halligan, in written testimony submitted to the Senate in connection with her nomination, attempted to conceal the extent of her anti-gun animus.   Halligan’s failure to provide information that would clarify her statements, thus keeping her testimony from being misleading, constitutes “fraud” against the Senate. As such, the only role she should play in the D.C. Circuit Court of Appeals is the role of a defendant.   But, of course, none of this matters to Harry Reid. He and President Obama are doing what they can to pack the Appeals Courts with radical leftists.   We have to stop this Reid/Obama court-packing scheme. Gun Owners of America Urge your Senators to put a stop to Republican-compromises   Anti-gun Sen. Charles Schumer's staff is leaking out to the press the Oklahoma Sen. Tom Coburn is "on the verge" of caving in and agreeing to a ban on private gun sales -- and requiring virtually every American to get the government's approval before exercising their constitutional right to become a gun owner.   According to The Washington Post (2/23/13), the remaining sticking point is Coburn's reluctance to require a 4473 for every private transaction.  Were this to occur, ATF's practice of going into gun stores and copying all the 4473's -- a practice which has been documented by GOA -- would soon produce a national gun registry.   Schumer's people have also let it be known that they may have Susan Collins (R-ME), John McCain (R-AZ), and Jeff Flake (R-AZ) in the bag.  (Note to gun owners in these states:  These Senators really need to hear from you!)   Let's assume, for the sake of argument, that the final version of the "Schumer sell-out" prohibits any paperwork from being kept on private gun sales.   Even then, the "Schumer Sell-Out" would still result in one out of seventeen legal gun purchases being permanently and illegally blocked.    According to scholar John Lott, 8% of all gun purchases are currently blocked by the FBI.  But, according to a recent study by the Department of Justice, only 1.8% of the 8% are blocked because they are "denied."  That means that 6.2% are neither "denied" nor "approved."  However, because most gun sellers won't sell a firearm under these circumstances, even after three days, these legal gun purchasers are permanently denied their constitutional rights by bureaucratic fiat.   Although the FBI is legally required to state a reason for blocking a gun purchase within five days, it NEVER complies with the law -- daring purchasers, instead, to "sue us."  Most purchasers, lack the means to do just that.   What if one out of seventeen lawful voters was illegally turned away from the polls?  What if one out of seventeen innocent men was illegally sent to prison?  What if one out of seventeen newspapers was shut down?  None of these would be acceptable to anti-gun zealots who, with relish, deny the right of legitimate gun purchasers to exercise their Second Amendment rights one out of every seventeen times.   The "Schumer Sell-Out" would still strip 150,000 veterans of their Second Amendment rights with no due process whatsoever.  Sure, there will reportedly be throwaway language, supposedly allowing veterans to get the constitutional rights back.  Schumer fooled Coburn into accepting comparable language on a 2008 law, but it never had any impact.  The problem is not "getting their rights back."  The problem is preventing their rights from being unconstitutionally stripped -- with no due process whatsoever -- in the first place.   Under the 2008 Schumer legislation, the Obama administration can use a psychiatrist's diagnosis to strip veterans and others of their constitutional rights.  No court order is needed.  Soon, under Obama's Executive Action Number 1, millions of Americans with ADHD, and even post partem depression could have their gun rights taken away with a keystroke by Medicare, Medicaid, and the Department of Education.  Firemen, policemen, and soldiers with PTSD could also lose their gun rights under the "Schumer sell-out," and there's nothing they could do about it.   The "Schumer Sell-Out" would exacerbate the problem with NICS system breakdowns during weekends and black Fridays -- blocking all gun purchasers.   The "Schumer Sell-Out" would strip farmers and Americans in rural areas of their Second Amendment rights.  Sure, there is a possibility that Schumer will accept do-nothing language in the Brady Law protecting remote Alaskan villages.  But millions of Americans would still have to travel hundreds of miles (accompanied by their sellers) in order to transfer a firearm to their next-door neighbor -- hoping desperately that they're not among the 6.2% of Americans who get a non-committal response from the FBI.   The "Schumer Sell-Out" would still be ineffectual to stop Adam Lanza (who stole his guns) and James Holmes and Jared Loughner (who passed background checks).  In fact, an internal Department of Justice memorandum concedes that it would be almost totally ineffectual.   As a result, the main purpose of the “Schumer Sell-Out” remains, and has always been, to “break the back of the gun … lobby” and to serve as a platform for the next round of gun control.   The Sunday New York Times (2/23/13) pointed out what this is all about.  According to the Times, Schumer is jealous to protect the 13 Democratic seats in pro-gun states which will come up in 2014.  Press reports ascribe Coburn’s role as being one who will “provide cover” for Democrats running for reelection.   From a purely partisan standpoint, the GOP should realize that guns will serve as a powerful political weapon for them, unless Coburn’s acquiescence to the “Schumer Sell-Out” takes guns off the table.  In places like Arkansas and Montana, 95% of all voters would no doubt oppose the "Schumer sell-out," as 95% of NRA members and 96% of 25,000 GOA members did in recent surveys.   Conversely, the "Schumer Sell-Out" will revitalize and engerize the handgun control movement.   Finally, the "Schumer Sell-Out" will give Obama the aura of invincibility and make it virtually impossible to stop the rest of his agenda.   If Sen. Gun Owners of America Will the U.S. Follow Germany's Example? The country that invented Nazism sets up national gun registry   Something very instructive just happened in Germany.   Germany just implemented "a vast registry that details every legal gun owner in the country, along with information about all of their firearms."   They did this, based on records that, in some cases, "were kept on index cards across what used to be 551 separate local registries."     Thus, with everyone's name already on an index card (read:  4473 forms) in what was effectively a "universal background check," it was a small step to a national gun registry.    Not surprisingly, "gun rights groups" in Germany raised no real opposition.  "We are used to it," said one.   Now, in the words of The Washington Post:        If they are preparing a raid on a house, they can scout the address in the database to be better prepared for what weapons might lie within.  Before the database, they could only guess at overall numbers, and finding the weapons registered to a certain address had been laborious.   Do we need any better indication of why "universal background checks" are the most insidious aspect of Barack Obama’s gun control?    We know that gun confiscation is the ultimate endgame for many of the gun grabbers on the Left.  Consider just a few, recent well-known cases:   * "Confiscation could be an option," declared New York Governor Andrew Cuomo in a radio interview (December 27, 2012).   * "We cannot have big guns out here," said Iowa Rep. Dan Muhlbauer. "Even if you have them, I think we need to start taking them." (Interview with the Iowa Daily Times Herald, December 19, 2012.)   * "No one is allowed to be armed. We're going to take all the guns," said P. Edwin Compass III, the superintendent of the New Orleans police, right before several law-enforcement agencies began confiscating the firearms of lawful gun owners in the wake of Hurricane Katrina (2005).   The task of confiscating guns is much easier when the government has a registration list.  And that is the number one reason gun owners should oppose background checks, because they give federal bureaucrats the framework for a national registration system.   If Obama gets his way, we will be much further down road to giving the Andrew Cuomos of the world the registration lists they need.    Some liberal gun-grabbers are trying to paint it as "non-controversial."  But this hideous provision requiring every American to get the permission of the government before exercising their Second Amendment rights must be stopped.      ACTION:  Click here to contact your Senators and Representative.  Insist that they oppose the national background check, which would set the framework for a national gun registry and confiscation.
