Interesting article... I'm on the side of the ACLU with this one. The photo looks like the device plugs into the phone... thus you must turn your phone over to the cops. A device which does it via proximity to your phone without being connected (i.e. like WiFi) can't be too far behind. Clear 4th Amendment violation.
