Vice presidential Candidate Wiley S. Drake Sr. to file in court asking to de-certify Barack Obama because he has refused to release proof of being a Natural Born Citizen, thereby disqualifying Obama in his bid for the Office of President.
The recent Lawsuit in Washington State demanding their Secretary of State to vet the citizenship credentials of Barack Obama has spawned a slew of similar suits with new lawsuits filed and/or prepared in WA, FL, NC, CO, CA, OH, FL, CT, GA, TX, MI. Related lawsuits HI, US District.
As part of this effort, this group of citizens from states across the union made an outreach to the whole presidential slate asking each candidate for president and vice president to offer up a certified copy of their birth certificates and any related candidate declarations to be placed in a library made available to the public via a non-partisan web site.
At least one VP candidate Wiley S. Drake Sr. went the next step and agreed to file a lawsuit of his own to demand the disqualification of Barack Obama unless he can prove status as a ”Natural Born Citizen” as the constitution and federal statues demand and define.
In another unrelated action, though also aimed at forcing Obama to release proof or step down, 24 potential Electoral College electors are filing action Monday morning in court also demanding proof. A call is herein being issued to any elector in any state, especially democrat electors who would like to join that effort. Electors interested in adding their name to this lawsuit can contact Mr. Marquis who will put you in contact with the attorney handling that case.

The press release doesn't give any info about the electorals home states or the court information on either of Monday's upcoming filings.
IIRC, Steve Marquis, recently had his personal lawsuit dismissed in WA state for his lack of standing.

Say it ain’t so, O! I should HOPE at least a candidate who’s on the ticket somewhere has standing since the citizens apparently do not.
The way this reads these citizens are demanding the various Secretary’s of State ask for Obama’s birth certificate. What if the Secretary’s of State just say no they won’t ask. Case closed, right?
Constitutionally, electors must have standing in court since they actually vote for the president.

Actually, one could argue that without proof of his eligibility to serve as President, the electors would be bound to vote against NObama, i.e. they have a remedy that doesn’t require judicial intervention.
Would they legally be able to do this even if Obama won the vote in their state? Has this ever come up before?

My understanding of one of the reasons for electors is that they were to have final say because many Americans at the beginning of our nation weren’t educated enough to make good decisions. Sadly, that still applies. Perhaps the only reason the Electoral College is still around is the other reason, to balance small states vs. large ones. Electors can vote however they want, although they usually appear to echo their states’ majority vote.
When you vote for President, you are voting for a slate of electors. If Obama wins your state, the Obama electors get to represent your state in the Presidential election. Given our current partisan environamnet, they would vote for Obama no matter what, even if there is evidence that he is not a natural born citizen.

The Constitution does not say that the remedy is to not vote for someone who may not be a natural born citizen. It says that they not eligible to become President. It is not against the law for one to vote for them but they cannot become President. If you want to you can vote for your dog. We have the Constitutional right guaranteed to us that we have a natural born citizen as our President. It was written into the Constitution for our protection against having a President with divided or other loyalties. Obama is a prime example as he said he would side with Muslims if there was a choice. He promoted a candidate in Kenya who was against the right of our country to extradite known terrorist against our country. His loyalties are all over the place.
Yes. There's been rogue electors in the past who have voted for the other candidate. Some states have laws that punish electors who do this...but such punishment would be after-the-fact, and there's some question as to whether these laws are even constitutional, i.e. whether the state has the power infringe upon the elector's powers.
Yes but doesn't the Secretary of State have to certify the election? If the electors go rogue, the SOS might just refuse to certify the election for that state.

If he was born in Kenya to an American Mom then he is not a natural born citizen but a naturalized citizen like Gov. Schwarzenegger.
If he was born in Hawaii but adopted by the Indonesian Lolo Soetoro his complete records would show this also. This would imply Indonesian citizenship that he probably never denounced making him an illegal alien like his aunt in Boston.
Yes, there have been “faithless electors” in the past. One in 1972, IIRC. They are not bound, as I understand it.

Many are convinced that if he would have released his entire military records and they in fact proved what he was asserting to be factual, it would not only have shut us up (including the Swift Boat Vets) but would have probably propelled him right into the oval office.

No, he needs to produce an official state/county issued birth certificate...the hospital issued certificate of birth has no legal meaning and is not even adequate to obtain a passport. He went to Pakistan on an Indonesian passport testifying to the fact that he was an Indonesian citizen and since he had an Indonesian citizenship he couldn’t have been an American citizen....by the way it was illegal for an American citizen to travel to Pakistan then....of course it was illegal to use cocaine also, so on many fronts we are on the verge of putting an admitted law-breaker, Marxist in the White House....say it isn’t so!

The electors will vote the President Elect into office under duress and undue influence. At which point since they are in violation of our election laws & Constitution. What is our recourse and do we Republicans have the guts to pursue it? Are we willing to hold the Democrat Party to account? Or will we rollover like so many times before and let the Constitution fall into the dustbin of history, that is the very real question we are faced with. Even now, today before the election, at the request of the people voting, we're asking for a fully vetted candidate on the very basics of what is required to hold the office of President.
It won't be the fact that the Democrat Party committed:
1. a fraud and
2. treason against the American people.
3. the media abetted it, when they had a responsibility to report it.
If this begins to unfold, we need to be ready to educate and help calm the nation.
We then need to be prepared to hang this around the Democrats neck as a negligent act and even high treason.

There are many reasons that Barack could be just trying to run the clock out.
1. Regardless of what his birth certificate says, Barack’s may be an American (which would mean that a birth in Kenya would be insignificant). This could be proved by DNA testing. Of course it would also prove Barack’s ties to Bill Ayers. After Tuesday that doesn’t matter (a proven causal link between Barack and Bill Ayers), except possibly in 2010 (mid-term elections) and/or 2012 (for his re-election).
The Democrats are going to push their agenda for higher taxes (which can be accomplished by doing “nothing” — letting the Bush tax cuts expire) — a $500 per working person refundable tax credit (which will essentially be a “welfare” check for about 48% of America who after the check will have zero or “negative” Federal Tax due). Democrats will push to get approximately 2-3 dozen million (24,000,000 to 36,000,000) under the umbrella of the federal government health insurance plan. They will accomplish this by placing hefty fines ($5,000-$10,000 per employee) on “small businesses” (which will be catergorized as having more than 10 employees). Of course this will cause many small businesses to kill existing jobs and not hire additional people. This will be Barack’s/their first step to getting us halfway to a single-payer system (what Barack has admitted he would prefer if he could start from scratch).
2. I don’t pretend to understand the Indonesian citizenship thing completely. I would not be surprised if Barry had/has two passports (an Indonesian passport and a US passport) at least until 1981 (when he was 18/19 years old). Even though Indonesia does not have dual citizenship, I would not be surprised that you could get two passports. What you should really want to see is a US Passport

Many in the main stream media are seeing the Barack Obama birth certificate issue and/or his citizenship as a joke, or at the very least a wild goose chase that will go nowhere.
One judge in Pennsylvania has ruled that a US citizen "has no standing" to require a presidential candidate to prove (ahead of an election) that he/she is truly qualified to serve.
Our Constitution, from what I can tell, requires that the Electoral College deem a candidate qualified to serve. If we have to wait until the Elector College step to deem Barack Obama qualified to serve, it will place our nation into a constitutional crisis the likes we have never seen.
When Barack Obama went to Hawaii to see his sick grandmother, he also had the governor seal his birth records until after the election. Why, and why was this odd request granted?
Since the court in Pennsylvania found that a US citizen "had no standing", a current Vice Presidential Candidate from the American Independent Party feels he may "have standing" since he is in competition with Barack Obama. Also, 24 Electoral College delegates will be filing some kind of protest tomorrow (per the news release below).
Please assure me that a proper challenge will be raised at the Electoral College step.
I still feel John McCain will win, but if not, we will face an historic constitutional crisis.

My opinion: Because he was born in Keyna, and his mother was a U.S. Citizen and his father was a citizen of Keyna, so his mother registered his birth in Hawaii. This is common. But the registration WILL SHOW the place of birth — KEYNA — and that is what Obama does not want released.
Because it does open up the discussion of Obama’s citizenship. I would bet money that in at least some of Obama’s applications (college, bar, little league, sunday school, etc.) he gives his birth place as Keyna. He may have also put in writing that he was a citizen of Indonesia on some documents. There is a copy of an Indonesian passport on the Internet. Apparently, he has an Indoneasian passport and NOT a U.S. passport.
To get a U.S. passport, one MUST show a birth certificate — hmmmmmmmm.
