Letter from Sen. George LeMeuix re keeping the internet free and unfettered (reply to my note)

Thank you for contacting me regarding net-neutrality. I appreciate hearing from you on this important issue, and I would like to respond.

Americans have benefited greatly from access to the Internet. It has revolutionized both communication and commerce in our country, and the benefits for education and health care are growing daily. To increase Internet access, Congress has taken a number of steps to promote broadband deployment through tax incentives, grants, and loan programs. Expanding the availability of broadband and ensuring unfettered access to the Internet are critical for the future of our country.

The information that is transmitted over the Internet travels via infrastructure owned and operated by a variety of public and private entities, or network operators. These network operators are responsible for the security and maintenance of their networks, which often represent a significant financial investment. With the growth in demand of broadband content, network operators have relied on systems of prioritization and deep packet inspection to manage the flow of information over their networks. This ability to distinguish and prioritize information allows network operators to guard their networks from potential harm while attempting to maximize service to customers. However, this practice has given rise to concerns about potential market abuses and anti-competitive behavior if network operators use this ability to discriminate against competitors.

As you may know, the Federal Communication Commission (FCC) adopted a notice of proposed rule-making on October 22, 2009 seeking comments on “the best means of preserving a free and open Internet.” I support a free and open Internet, but I also believe that network operators should be able to manage their networks to ensure efficiency and avoid harm. This will require a careful balance between assuring access and allowing network operators to manage their networks. Clearly, any anti-competitive behavior or market manipulation needs to be prohibited to ensure a competitive environment, but the regulations should not be so intrusive as to dissuade necessary private investment in broadband infrastructure or telecommunications innovation.

This is a complex issue, and I intend to monitor this rulemaking process closely to ensure that the dual goals of increased availability and unfettered access to the Internet are protected. Additionally, I will carefully review any legislation that comes before the Commerce Committee or the full Senate to ensure that the interests of Floridians are represented.

It is an honor and privilege to serve the people of the great State of Florida in the United States Senate. I take great pride in being a native Floridian, and I look forward to the tremendous opportunity to better the lives of all Floridians.
